Discord is looking for an exceptional Trust & Safety (also known as Security) Counsel to join our growing legal team. This is a high-impact role at one of the most interesting companies on the planet! As our (first) Trust & Safety Counsel, you will be the main point of contact for Trust & Safety escalations and will help shape our strategy for managing, creating, and articulating responses to requests from law enforcement, regulatory bodies, and government agencies globally. You get to partner closely with internal and external partners to proactively identify and mitigate potential issues and advise on complex, multifaceted, and often novel legal risks. You'll provide expertise, help operationalize related processes, drive critical missions, and you will have a significant impact on how the Legal team delivers enduring growth and value. What you'll be doing:

  • Assist the Trust & Safety, Policy and Support teams with responses to legal requests to ensure proper implementation of our policies and identify edge cases that need closer consideration, and provide legal guidance for Trust & Safety escalations.

  • Develop and improve scalable training materials, macros, and workflows for legal issues and escalations, including partnering with our Platform Policy and Trust & Safety teams to update and translate internal policies (such as our Community Guidelines) into actionable processes.
  • Collaborate with cross-functional partners to implement and maintain scalable processes for data reporting, data subject access responses, law enforcement responses, and others as required by law with user safety and user data protection in mind.
  • Support engagement with regulators and legislators on safety issues and serve as primary point of contact on these issues.
  • Keep up-to-date on new legislation, regulations, and case law related to key laws (including DSA, Inform Act, CDA 230, DMCA, CLOUD Act, ECPA/SCA, 18 USC § 2258A) to ensure the company maintains the highest compliance standards. 
  • Collaborate with product counsel to advise on trust and safety issues in existing and planned products. 

What you should have:

  • JD from an accredited law school.

  • Admission to the California Bar or eligible to register as in-house counsel with the California Bar.
  • 6+ years of legal experience, including government, in-house and/or law firm experience advising technology companies, including demonstrated work experience in the area of trust & safety and regulatory affairs.
  • Strong knowledge of relevant regulatory requirements such as Inform Act, DSA, CDA 230, ECPA/SCA, 18 USC § 2258A.
  • Experience responding to law enforcement requests (i.e., subpoenas, warrants, emergency disclosure requests) and helping internal teams evaluate proactive disclosures.
  • Experience reviewing processes and process documentation to ensure compliance with applicable regulations.
  • Ability to proactively identify risk areas and participate in developing training and policy or process enhancements
  • Experience working on multiple projects delivering practical advice under pressure and operating within ambiguity; a collaborative and strategic focus is essential.
  • Curiosity and ability to jump into less familiar areas and learn while doing.

Bonus Points:

  • In-house legal department experience with a consumer-oriented tech company.
  • Experience taking on projects involving different subject matters and working with cross-functional partners & organizations to drive alignment.
  • Experience dealing with foreign governments and/or foreign legal process.
  • Experience handling sensitive and/or confidential matters; previous or current security clearance.
  • IP experience, especially in the area of IP enforcement response (e.g., DMCA Notices, etc.) and/or working with rights holders.
  • Privacy law experience.

The US base salary range for this full-time position is $201,000 to $219,000 + equity + benefits. Our salary ranges are determined by role and level. Within the range, individual pay is determined by additional factors, including job-related skills, experience, and relevant education or training. Please note that the compensation details listed in US role postings reflect the base salary only, and do not include equity, or benefits.
